
Collaborative Divorce
Collaborative Divorce is a voluntary form of dispute resolution in which Parties settle their divorce with a unique form of alternate dispute resolution. Collaborative Divorce often includes the use of a Financial Specialist. Distinctions include:
- Empowers Parties to resolve legal disputes without judges, magistrates or court personnel.
- All Parties and Collaborative professionals execute a participation agreement, outlining roles, responsibilities, expectations, and tenants of good faith (e.g.- the agreement not to litigate, not to threaten to litigate, confidentiality, transparency, etc.).
- Provides Parties with a team, including Collaborative-trained attorneys, mental health professional(s), & a financial professional (typically a CDFA® Professional) to educate, support and guide them in reaching balanced, respectful and lasting agreements.
- Offers Parties a safe environment to minimize conflict and honor Parties’ history, children, family and future, post-divorce relationship.
Collaborative Divorce Services:
- Elizabeth supports the team as a Financial Specialist and she assists in providing tailored financial support, analysis, guidance, and reporting.
- Assistance in community and separate property analysis, asset division, and recommendations.
- Analysis of potential settlement offers.
- Analysis of each spouse’s current and future financial outlooks.
- Provides financial education, as needed, so that Parties can execute agreements by informed consent.
